Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of MarketBall (“the Service”), operated by Seth Wyatt Griffin (“we”, “us”, or “the seller”). By creating an account, subscribing, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

MarketBall is a fantasy sports analytics and information service. We analyze publicly available prediction-market data alongside traditional fantasy football data to produce rankings (MarketRank™), player analysis, market signals and editorial content. Paid subscriptions provide access to that analytics and content — nothing else.

MarketBall does not, and does not purport to:

• provide gambling, betting or wagering services, or accept wagers of any kind;
• accept, hold or disburse wagering deposits or customer funds for trading;
• execute prediction-market trades, or enable users to buy, sell or otherwise transact in prediction-market contracts;
• operate paid-entry fantasy contests or award monetary or material prizes or winnings;
• provide investment, financial or gambling advice.

MarketBall is not affiliated with, sponsored by, or endorsed by Polymarket, Kalshi or any other venue whose public data we analyze. All content is informational and analytical. Our rankings and analysis are not guarantees or predictions of fantasy outcomes, results, winnings or financial returns, and are not represented as more accurate than any other ranking source — they are a different signal. Market data can change rapidly, may be delayed, thin, incomplete or wrong, and we do not guarantee that any market information shown remains current. You remain solely responsible for your own fantasy and other decisions.

2. Account Registration

You must be at least 18 years old and capable of forming a binding contract to create an account. You agree to provide accurate, current, and complete information, and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. Acceptable Use

You may not use the Service to:

• Violate any applicable law or regulation;
• Engage in fraud, spam, phishing, or deceptive practices;
• Infringe any intellectual property or other rights of others;
• Interfere with the security, availability, or performance of the Service, including by distributing malware, probing, scraping, or circumventing any rate limits or access controls;
• Reverse engineer, decompile, or attempt to extract the source code of the Service;
• Resell, redistribute, or sublicense access to the Service without our consent.

4. Intellectual Property

All content, software, branding, and materials provided through the Service are owned by Seth Wyatt Griffin or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.

5. Subscriptions, Payments & Refunds

MarketBall offers both free and paid subscription plans. Paid plans are billed in advance at the price and cadence shown at checkout. Monthly and annual plans renew automatically until cancelled; the NFL Season Pass is a one-time purchase that does not auto-renew.

Payments may be processed by third-party payment service providers. MarketBall does not directly store complete payment card information. Applicable taxes may be added at checkout.

Cancellation. Cancelling stops future renewals. You keep access to paid features through the end of the billing period you have already paid for. We do not prorate or refund the unused portion of a billing period. Self-service billing management is not yet available — to cancel, email marketballsupport@gmail.com and we will process your cancellation.

Refunds. Subscription payments are generally non-refundable once charged. If you believe you were charged in error, or believe exceptional circumstances warrant a refund, contact MarketBall support and we will review the request. See our Refund & Cancellation Policy for details.

6. Service Level

We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Data displayed on the Service may be delayed or incomplete. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

7. Termination & Suspension

We may suspend or terminate your access to the Service, without notice, for: material breach of these Terms, non-payment, suspected fraud or security risk, repeated or serious violations of our acceptable use rules, or any other conduct that we determine harms the Service or other users. Upon termination, your right to use the Service immediately ceases, and any outstanding subscription fees may remain due.

8. Limitation of Liability

To the fullest extent permitted by law, Seth Wyatt Griffin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms limits liability for fraud, death, or personal injury where required by law.

9. Indemnity

You agree to indemnify and hold harmless Seth Wyatt Griffin from any claims, damages, liabilities, or expenses arising out of your use of the Service, your account content, or your violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Illinois.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
